The last three years of Kyacey Uscola’s court life in Sacramento

On June 24th, 2010, Kyacey Uscola filed a civil suit in Sacramento Superior Court against property owners/landlords Chris & Megan Woolsey along with resident/occupant Gary Martin. The suit alleged that Martin was the owner of two dogs and that the dogs bit Uscola. From the Complaint:
As a proximate result of the acts and omissions of said defendants as alleged herein, Plaintiff was hurt and injured in Plaintiff’s health, strength and activity, sustaining grave bodily injuries to Plaintiff’s nervous system, urinary system and person, all of which have caused, and continue to cause, Plaintiff great mental, physical and nervous pain and suffering. Plaintiff is informed and believes and thereon alleges that said injuries will result in some permanent disability to Plaintiff…
Uscola claimed the dogs were unleashed.
Life after the civil suit was filed took a dramatic turn for the worse.
The first incident
On January 4th, 2011, Uscola was arrested and charged with three felonies (one count of threatening bodily harm (PC 422 along with one count of false imprisonment (PC 236) along with one count of corporal injury to a spouse/cohabitant (PC 273.5(a))) & one misdemeanor (child endangerment (PC273A(b))).
He pled to a misdemeanor count of battery (273.5(A)) and was given 3 years of supervised formal probation, underwent and completed a batterer’s treatment program course, and had a restitution hearing.
His probation term would have expired on January 25th, 2014.
The second incident
On June 18th, 2013, Uscola was charged by the Sacramento District Attorney’s office with four felonies & three misdemeanors after being arrested on June 15th, 2013 by the Sacramento County Police Department for the following:
13-157024 (Domestic Violence): 2100 block of Sandcastle Way at 0115 hours.
Officers responded to the area in an attempt to locate a subject wanted for domestic violence charges. Upon arrival the suspect was again in the act of assaulting his wife and taken into custody. Kyacey Uscola, 31, was booked into the Sacramento County Jail for multiple charges to include domestic violence, child endangerment and false imprisonment.
One of the misdemeanor counts against Uscola was dropped, leaving him staring at four felony & two misdemeanor charges.
In December of 2013, the case went to trial. On January 14th, 2014, jury deliberations commenced. A motion for mistrial was denied. On January 17th, the jury convicted Uscola on four of the six charges. Three of them were felony charges (one count of domestic battery (PC 243(E)(1)) along with one count of serious bodily injury (PC 243(D)) resulting from one count of battery/corporal injury (PC 273.5(A)) and one misdemeanor charge (violating a protective/stay-away order (PC 166(C)(1)).
Here is how the Sacramento DA’s office commented on Friday’s jury conviction of Uscola. The press release:
District Attorney Jan Scully announced today that Kyacey Uscola was convicted by jury of battery on a spouse or cohabitant battery with serious bodily injury, and corporal injury on a spouse or cohabitant. The jury also found true that Uscola personally inflicted great bodily injury upon the victim under circumstances involving domestic violence a nd that he has a prior domestic violence conviction.
Uscola is a professionally trained mixed martial arts specialist who has fought several professional fights for the Ultimate Fighting Championship. On June 15, 2013, he assaulted the mother of his child causing her to suffer significant injuries, including a punctured lung, eight broken ribs, two lumbar fractures, an orbital fracture, and a life threatening pancreas laceration.
Deputy District Attorney Kristen Ilharreguy states, “This conviction would not have been possible without the hard work of the Sacramento Police Department, District Attorney Criminal Investigator Diane Hall, and District Attorney Victim Advocate Lisa Corral.”
Uscola faces a maximum sentence of 13 years in prison. Sentencing is set for February 14, 2014 in Department 19 before the honorable Patrick Marlette
He’s being sentenced on Valentine’s Day. Around this time of sentencing for the criminal convictions, Uscola’s dog biting civil court case from 2010 is/was about to go to jury trial.
