Tuesday news review (3/4/08)

Yesterday in Clark County court, judge Elizabeth Halverson granted Xyience attorneys a month-long extension in time to respond to Rich Bergeron’s motion to dismiss the lawsuit against him. The next scheduled court hearing is on 4/3 at 8:30 AM. What makes that date interesting is that the cut-off date for Xyience in bankruptcy court is reportedly on April 1st. In other words, there’s a chance that this lawsuit by Xyience against Bergeron could be sold or treated as an asset in any sort of bankruptcy sale (based on my interpretation of sage-like wisdom given to me by Jeff Thaler).

    Well, you can sell your right to sue (including your right not to sue) at any time. The difference is that the judge could force it’s sale, I suppose.

    It would be interesting to see how the judge would value this lawsuit. There’s no real chance of collecting significant damages, the guy has no assets to speak of. He’s just a layabout rabble rouser looking for attention at this point.

    Not that there’s anything particularly wrong with that, but they should have ended this months ago. Total waste of time and money.

    Re: Washington violence.

    I always thought it was a proven fact that violence didn’t exist before video games and ‘ultimate fighting.’ Who can disagree with that?

    RE:Washington State University Violence

    Since WSU was my alma mater I can speak with honesty that they are a pack of drunken and/or retarded rednecks that had violence issues well before ‘ultimate fighting’ was even a shade as well known as it is today. Being a retard is the central issue interest in ‘ultimate fighting’ is a peripheral excuse.

    That and the rest of the state isn’t represented by Pullman – a town with a total of 35,000 people in it during a scholastic year. And so near to Moscow it may as well be considered Idaho which is even more full of sister sexers and the not so bright.

    I am also happy that Joe Rogan is backing other MMA promotions contributing to the sport.

    I got two motions on the docket, one of which will strike the extension. I will be filing orders shortening time on both motions today, and that will place the hearings on the docket before April 1. I’m also working on getting a pro-bono lawyer. Watch out Xyience, your luck is about to run out.

  7. Oh, I forgot to mention that even though the secretary told me the hearing was at 9:30, the Xyience lawyer went in beforehand and got the judge to have the hearing an hour earlier. So they went ahead without me and not only got their extension but also excluded me from appearing telephonically for the duration of the case.
