Divorce Property Division Agreement

Even today, contact Safi Law Group for retirement savings and PRSP help to ensure they are treated with care during a divorce or separation. In the Community property courts, marriages are considered a “50/50” partnership. The property is classified as either “conjugal” or “separate”. All marital property is considered to be half of each spouse`s property and is distributed equitably. The division of common ownership can be brutal and may not seem fair to either party, as the 50-50 rule is strict. The following types of real estate and personal property are examples of marital property: You can also use debt to compensate someone who receives more from the property. The petitioner and the respondent agree to waive all rights that each may have in each other`s pension. All other age accounts that are now held and maintained individually are and will remain the separate property of the spouse in whose name the property is now held. Parties can save thousands of dollars by clicking on their separation or divorce case outside of court. This is where family agreements are put in place.

By creating a legally binding separation/marriage agreement, the parties can resolve all issues such as custody, child custody, spouse maintenance and division of property outside of court and conclude their divorce much faster and cheaper. However, in some cases, the parties may not agree on some or all of the issues. In these cases, the Court of Justice must be assisted. In both cases, the final judgment of the divorce has yet to be delivered by the Court of Justice. However, if the parties have already reached an agreement, the final divorce decision will be rendered without anyone having to appear in court. An experienced lawyer can help you establish a strong legally binding agreement and get a final divorce decision for you. In the case of a mixture of individual and collective ownership, the property can be considered as common property in the event of a “meeting”. For example, if a husband buys a vacation home before getting married, but later adds his spouse`s name as a co-owner of the vacation home, he may lose his status as a separate property. The holiday home is mixed and classified as marital property.

When a couple divorces, they often go through the process of dividing assets (furniture, cars, frequent flyer miles) and debts (mortgages, credit cards, etc.).
